Le cours Espace de Liberté, de Sécurité et de Justice est composé d’une première partie dispensée en anglais, « The Area of Freedom, Security and Justice as a domain of European Union governance” (Jörg Monar) et d’une seconde partie dispensée en français visant à balayer des grands thèmes relevant du droit matériel de l’Espace de Liberté, de Sécurité et de Justice (Fabienne Gazin).

En 24-25, cours dispensé par : Jörg Monar, professeur honoraire d’études européennes, Collège d’Europe, ancien recteur du Collège d’Europe et Fabienne Gazin, maître de conférences habilitées à diriger des recherches en droit européen, Université de Strasbourg.

Syllabus

Part A: The Area of Freedom, Security and Justice as a domain of European Union governance

This part of the course will explore the foundations of the European Union’s (EU) “Area of Freedom, Security and Justice” (AFSJ) as a fundamental EU Treaty objective and relative recent and specific area of EU governance. It will first look at the transnational internal security challenges and action needs generated by European integration advances in other fields which account for the establishment of the AFSJ and its further development, bringing out the persisting tensions between Member State persisting competence reservations and the gradual expansion of common objectives. The main focus will then be on the legal provisions of the Treaties (defining both the potential and the limitations of EU action in the AFSJ domain), the specific roles of the EU institutions and of the (numerous) specialised agencies in it and predominant governance methods (coordination and common programming, information exchange, operational cooperation, harmonisation, mutual recognition). Finally, the practical functioning of AFSJ governance will be critically assessed – with concrete examples and on the basis of recent official documents - through a survey of progress and problems of EU governance in two fields of major political relevance, external border management and counter-terrorism.

2.4. Governance methods (coordination and common programming, information exchange, operational cooperation, legislative harmonisation, mutual recognition, mutual evaluation) 

3. ELSJ governance in practice: a critical assessment
3.1. The example of EU external border management (development, key elements and problems)
3.2. The example of EU counter-terrorism action (development, key elements and problems)

2ème partie du cours

1.Libre circulation des citoyens de l’Union européenne dans l’Espace de liberté, de sécurité et de justice : l’exemple du cas pratique donné au CRFPA en septembre 2023 (option droit international et européen)

La résolution en séance du cas pratique offre l’occasion à la fois de découvrir les exigences d’une épreuve de haut niveau dans un examen juridique et de comprendre les enjeux concrets et théoriques de la circulation des citoyens européens dans un espace sans frontière intérieure couplée à un risque d’extradition vers un État tiers

2. Le Pacte sur la migration et l’asile (1)

La première séance sur le Pacte vise à identifier si les droits fondamentaux des ressortissants de pays tiers (droit au non-refoulement/droit d’asile) sont suffisamment garantis par les normes du Pacte. Les mécanismes mis en place pour protéger les droits fondamentaux aux frontières extérieures de l’Union semblent-ils suffisamment efficaces ? Les juges européens sont-ils dans tous les cas compétents pour connaître des violations de droits fondamentaux aux frontières extérieures ?

3. Le Pacte sur la migration et l’asile (2)

La seconde séance portant sur le Pacte cherchera à évaluer et à apprécier le degré d’européanisation de la politique migratoire de l’UE résultant des orientations proposées par le Pacte.  Pourquoi l’on peut affirmer que le Pacte réduit la marge de manœuvre des Etats membres en matière de mise en œuvre de ces politiques ? Quels sont les leviers qu’utilisent l’UE pour accroitre son emprise sur ces politiques ?

4. Les difficultés d’application du mandat d’arrêt européen :

L’instrument de coopération judiciaire pénale existant depuis 2002, le mandat d’arrêt européen, a connu un grand succès. Son application peut parfois être délicate, en particulier lorsque l’exécution d’un mandat d’arrêt peut conduire à un risque de violation très grave des droits fondamentaux ou encore en l’absence d’exacte identité des intérêts protégé dans les deux Etats concernés.
La séance donnera l’occasion d’approfondir deux arrêts de la CJUE : aff. C-216/18 LM et C-168/21 « affaire Vincenzo Vecchi »
